Worth knowing
- Pennsylvania is a choice no-fault state. When you buy a policy you elect either limited tort or full tort, and that election governs your right to sue.
- Limited tort costs roughly 10 to 15 percent less but bars you from suing for pain and suffering unless your injury meets a serious injury threshold: death, serious impairment of a body function, or permanent serious disfigurement.
- Full tort keeps your unrestricted right to sue for any injury. If you do not actively choose, the policy defaults to full tort.
- You will not know whether an injury clears the limited tort threshold until after the accident.
- Every policy must include at least $5,000 in first-party medical benefits, which pay your own medical costs regardless of fault.
- Because the liability minimums are so low, underinsured motorist coverage on your own policy is often the more important protection.
